The reduction of a check is an offense under Section 138 of the Negotiable Metals Act, 1881 (“the Act”) punishable by a fine which can double the value of a check or imprisonment for a period not exceeding two years or both. When a payer submits a check to a bank for payment, and the check is returned unpaid by the bank with an inadequate cash register, it means that the check has failed. A check bashing may occur for a number of reasons, but if the check bounces off due to insufficient funds in the drawer account, it is the same as an offense under the Act.
