The burglary of a check is a violation of Section 138 of the Neglected Metals Act, 1881 (the "Law"), which carries a fine up to twice the amount of a check, or a sentence of two years' imprisonment, or both. The check is said to have been canceled by the borrower who submitted it to the bank for payment and then returned the bank without paying and the proof of insufficient funds. A check break may occur for a variety of reasons, but it is an offense under the Act if a check fails due to insufficient funds in a draw account.
