According to individual law expert A Kumar, "Under the Hindu Marriage Act, 1955, no marriage is regarded to be cancelled unless the husband and wife become legally divorced." If the property is held in the husband's name, the first wife has no claim to it in the event of a divorce. She does, however, have the right to request maintenance for a lifestyle that is equal to that of her spouse up until the point at which she marries again. When a man gets remarried, the second wife gains the right to inherit a portion of the man's assets while the first wife loses that right. Yet, the first wife's children continue to be entitled to a part. The wife typically has the right to remain in the home until the divorce is finalised even if the husband and wife frequently buy a property together. If she is a co-owner of the property, the husband cannot demand that she leave. Before or after the divorce, the wife may request her portion of the property as payment for her share from the husband, and the husband is responsible for covering her portion.
